Default Primary and Secondary Insurance

My question involves insurance law for the state of: Massachusetts and Montana



Hello, My son is currently covered under my health insurance in Massachusetts until he is 26 years old. He recently graduated from college. He has a full time job in Montana which provides him with a better policy than I have. (I have an HSA with a high deductible) He only plans to keep this job until August of next year at which time he will start graduate school. He will be 25 years old. I did not want to take him off my insurance for 2 reasons 1 He was in a serious accident one year ago and I am concerned that if I cancel the insurance his new insurance will consider it a preexisting condition and not provide coverage and 2 he will have to go back on my insurance once he is in graduate school. I thought the second policy would just pick up what the first policy does not cover but I guess that is not the case. Any advice or thoughts on what I should do? I am not sure if I should just take him off my policy and let the other cover everything and then put him back on my insurance when he starts graduate school. Any help would be greatly appreciated.

Is he still receiving treatment for injuries caused in the accident?
