Default Covered for a Month but Didn't Pay Premium Because I Was Never Billed

My question involves insurance law for the state of: NJ



When my daughter graduated from college and turned 22 (in May 2008) she would no longer be covered by my employer coverage but was able to be covered under the NJ under 30 plan (thru the same insurer-Blue Cross Blue Shield). I filled out all the forms, submitted them and she received a card. I called many times asking what the premium was and each time was told I would get a letter in the mail stating the premium. I got many letters ( at least 8) all saying that I was to send in the enclosed coupon each month to them with a check made out to the amount shown. However, there was NEVER a coupon book. I kept calling and kept getting the same letter with no coupon book. THis went on for the month of JUne 2008. On JUly 1, 2008, my employer switched my coverage to another insurer (Cigna). My daughter was covered under this plan.

The problem was that in June 2008 my daughter was seen in the emergency room of a local hospital, All the bills for the physicians and hospital were paid by BCBS. NOw fast forward to May 2009-I get a letter saying that she was not covered and we must reimburse them for the total amount. In August (15 months after the hospital stay) I just got a letter fron BCBS stating she was not covered at that time and I must reimburse them for the hospital costs they paid. What should I do?

You chose not to pay the bill, seemingly under the impression that you only had to do so if you had a coupon book of some sort, and thus you never paid for the insurance - despite getting at least eight letters stating the premium and instructing you to pay. Thus she was uninsured. You accepted a benefit under insurance you chose not to pay for, and they are entitled to reimbursement.



You can try negotiating with them for a reduction in the bill, a payment plan, or whatever you want, and see what they say.
